Maxx-Maintenance – Terms of Service

Effective Date: 12/01/2024

Welcome to Maxx-Maintenance! By subscribing to our home maintenance service, you agree to the following Terms of Service. Please read these terms carefully as they constitute a legally binding agreement between you and Maxx-Maintenance.

1. Service Overview
Maxx-Maintenance provides a subscription-based home maintenance service offering routine household repair and maintenance services. Subscribers pay a monthly fee for access to these services, which are intended to address common household needs as specified in our Service Scope below.

2. Subscription Agreement
By signing up for our subscription service, you agree to:

Pay the specified monthly fee for the duration of your subscription term.
Continue payments each month until the agreed-upon subscription deadline, as specified in your service agreement.
Non-Payment: Failure to pay any monthly fee by the due date may result in suspension or termination of services. Maxx-Maintenance reserves the right to pursue any legally available remedies to recover unpaid fees.

3. Subscription Term and Renewal
Initial Term: Your subscription begins on the start date specified in your agreement and will continue for the duration selected (e.g., 6 months, 12 months).
Renewal: At the end of the initial term, your subscription may be renewed to a new available plan or to the previous plan purchased, unless you notify us of your intent to cancel as per Section 5.

4. Payment Terms
Monthly Fee: The monthly subscription fee  must be paid in full at the beginning of each billing cycle.
Automatic Billing: By entering into this subscription agreement, you authorize Maxx-Maintenance to charge your designated payment method each month on the recurring billing date.
No Refunds: Subscription fees are non-refundable, even if you choose not to use the service in a given month.

5. Cancellation and Termination
Cancellation: You may cancel your subscription after fulfilling the agreed-upon term by providing written notice (Email) or verbal notice (phone) to Maxx-Maintenance at least 30 days prior to the next billing cycle.
Early Termination: In cases of early termination before the agreed term is fulfilled, you will be responsible for paying all outstanding fees for the remaining months of the term.
Company Termination: Maxx-Maintenance reserves the right to terminate your subscription at its discretion, including cases of non-payment or breach of this agreement.

6. Scope of Services
Covered Services: The subscription includes a range of general maintenance and repair services, which may include:

Minor plumbing repairs
Basic electrical work
Small carpentry jobs
Appliance troubleshooting and maintenance
Other household repairs as determined in the scope agreement
Limitations: Services are limited to general household repairs and maintenance only. Major structural, specialized, or hazardous repairs (e.g., HVAC, roofing, large appliance repair) are outside the subscription scope and may require additional fees or referrals.

Materials and Parts: Costs for replacement parts or materials required to complete a repair are not covered under the subscription and will be billed separately, subject to prior approval.

7. Service Scheduling
Appointments: Subscribers may schedule maintenance appointments by contacting submitting 

a work order via Maxx-maintenance.com


Hours of Operation: Services are provided during regular business hours, [e.g., Monday through Friday, 8 AM to 5 PM].
Cancellations: Appointments should be rescheduled or canceled at least 24 hours in advance to avoid charges.


8. Customer Responsibilities
Property Access: You agree to provide safe access to the property on the scheduled service date.
Safety Conditions: The property must be in a safe condition for our technicians to perform repairs.
Compliance: You agree to comply with any applicable local, state, or federal laws regarding home maintenance services.


9. Warranty and Liability
Warranty: Maxx-Maintenance.com offers a limited [e.g., 30-day] warranty on all parts used in repairs.

 

Liability: To the maximum extent permitted by law, Maxx-Maintenance disclaims any liability for incidental, indirect, or consequential damages arising from delays, issues beyond our control, or unauthorized alterations to our work.
Indemnification: You agree to indemnify and hold Maxx-Maintenance harmless against claims, liabilities, damages, or losses arising from your breach of these terms or misuse of our services.
10. Modifications to Terms
Maxx-Maintenance reserves the right to update or modify these Terms of Service at any time. Any changes will be communicated at least 30 days prior to their effective date, and continued use of the service after this period constitutes acceptance of the updated terms.


11. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of Washington State, without regard to its conflict of law principles.
